T&C

10 articles · Last updated 27 October 2025

These Terms and Conditions ("T&C") constitute a legally binding agreement between You ("Customer") and Arqonara ("Service Provider"). BY REGISTERING FOR, ACCESSING, OR USING ARQONARA'S SERVICES, THE CUSTOMER DECLARES THAT THEY HAVE READ, UNDERSTOOD, AND AGREE TO ALL OF THESE TERMS WITHOUT COERCION.

Arqonara has the absolute right to modify, add, or remove any part of these T&C at any time without prior notice. Continued use of the service by the Customer is deemed as absolute acceptance of such changes.

Arqonara provides hosting infrastructure services (including compute, game servers, and storage). All Arqonara Services are provided on an "AS-IS" and "AS-AVAILABLE" basis. Arqonara expressly disclaims all forms of implied warranties or guarantees, including but not limited to warranties of merchantability, fitness for a particular purpose, uninterrupted availability, absolute security against hacking, or absence of system defects.

  • The Customer bears all operational risks of server usage, including data management, software installation, modpacks, and security configuration.
  • The Customer must regularly back up data to a location outside Arqonara's infrastructure. Arqonara is fully released from any claims regarding data loss, damage, or leakage (data loss/corruption).
  • The Customer is prohibited from using the service for illegal purposes (gambling, pornography, hacking, DDoS attacks). Arqonara has the right to terminate the service unilaterally without a refund if a violation is found.
  • All fees paid to Arqonara are final and non-refundable for any reason, unless specifically provided for in the SLA policy.
  • The Customer is fully responsible for all forms of taxes, bank administrative fees, or third-party deductions related to infrastructure rental transactions.
  • Arqonara targets 99% infrastructure uptime. This target excludes downtime caused by scheduled maintenance, configuration errors by the Customer, cyber attacks (DDoS), client internet provider network issues, or Force Majeure.
  • If the SLA is not met, the Customer's sole right is to claim restitution in the form of service store credit of up to 30% of that month's bill. This restitution is the exclusive and only remedy available to the Customer.

Arqonara is released from all obligations, claims, or delays in fulfilling Services caused by events beyond our reasonable control, including but not limited to: natural disasters, government policies, mass power outages, submarine cable cuts, upstream provider failures, large-scale cyber attacks, war, or riots.

The Customer agrees to release, defend, and hold harmless Arqonara (including its directors, employees, and partners) from and against all claims, lawsuits, losses, court costs, or fines brought by any third party arising from:

  • The Customer's breach of these T&C.
  • Content, activities, or data hosted by the Customer on Arqonara servers that violate the law or the Intellectual Property Rights of others.
  • The Customer's negligence in managing their server.
  • UNDER NO CIRCUMSTANCES WILL ARQONARA BE LIABLE TO THE CUSTOMER OR ANY THIRD PARTY FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF BUSINESS PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION), EVEN IF ARQONARA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • If the law of a particular jurisdiction does not allow full disclaimer of liability, then the total accumulated liability of Arqonara for all claims arising from these T&C is limited to the total fees paid by the Customer to Arqonara in the 1 (one) month prior to the event giving rise to the claim.

Arqonara has the right to suspend or terminate the Customer's service unilaterally, at any time, and for any reason (including suspicion of activity that disrupts infrastructure stability) without any obligation to provide compensation of any kind to the Customer.

These T&C are governed by the civil law of the Republic of Indonesia. To minimize the risk of lengthy court proceedings, all disputes must be resolved through mutual deliberation within 30 days. If this fails, the Customer agrees that disputes will be resolved exclusively and finally through the Indonesian National Arbitration Board (BANI), not through the District Court.

This Usage Policy sets out the guidelines, obligations, and limitations binding on all customers and users of Arqonara services. By using our infrastructure and services, the Customer automatically agrees to and is bound by all of the provisions below.

  • Independent Content Management: The Customer is fully responsible for all data, software (including modpacks, plugins, and custom scripts), and end-user activities running on the rented server.
  • License Compliance: If the Customer uses third-party software within the Arqonara ecosystem, the Customer is strictly prohibited from copying, illegally distributing, or reverse engineering such software.
  • Credential Security: The Customer must keep authentication access confidential (such as control panel passwords, SSH keys, and API credentials). Any losses resulting from access leakage are entirely the Customer's responsibility.
  • Data Backup: Although Arqonara provides high-capacity storage infrastructure facilities, the Customer must perform data backups independently and periodically. Arqonara is not responsible for data loss or damage caused by Customer configuration errors, internal server software failures, or user negligence.

Arqonara services may not be used to store, process, or distribute content that violates the laws of the Republic of Indonesia or global norms. Strictly prohibited categories include:

  • Illegal Activities & Fraud: Operating gambling sites, fraud schemes (phishing/scam), child pornography, or other illegal activities.
  • Copyright Infringement: Storing or distributing pirated material that violates the Intellectual Property Rights of others.
  • Harmful Content (Malware): Uploading, running, or distributing viruses, trojans, ransomware, or other malicious code that could threaten the integrity of Arqonara's systems or external parties.
  • Offensive Content: Distributing hate speech, ethnic/religious/racial discrimination, threats of violence, or material that demeans the dignity of certain parties.

To maintain network performance and stability for all users, the Customer is prohibited from abusing the infrastructure, which includes:

  • Network Attacks (DoS/DDoS): Using Arqonara servers to launch Denial of Service attacks (flooding, broadcast attacks) targeting internal or external infrastructure.
  • Unauthorized Access & Scanning: Performing port scanning, penetration testing, or attempting to hack network systems, computers, and applications without written permission from the system owner.
  • Network Identity Spoofing: Manipulating TCP/IP packet headers, source IP addresses, or email headers to conceal identity or deceive data traffic routes.
  • Protocol Abuse: Running open network services vulnerable to exploitation, such as open proxies, illegal public VPNs for traffic bypass, open mail relays, or open recursive DNS servers.

The Customer is prohibited from using the Arqonara network to send unsolicited mass emails (SPAM), mail bombing, forced promotions, or manipulating email sender identity. The Customer is also not permitted to collect replies from spam messages sent through other service providers into the Arqonara infrastructure.

Arqonara prioritizes data privacy but retains the full right to maintain infrastructure stability through the following measures:

  • Network Interface Monitoring: Arqonara has the right to monitor external network interfaces (port traffic) to verify compliance and mitigate network anomalies. The Customer is prohibited from blocking or interfering with Arqonara's network mitigation systems.
  • Enforcement Actions: If a violation is detected, Arqonara has the right to investigate and unilaterally suspend, terminate, or restrict access to the offending server/content, with or without prior notice.
  • Legal Reporting: Arqonara will fully cooperate with law enforcement agencies and relevant institutions, which may include handing over user information and system logs, should indications of criminal activity be found.

We invite Customers to help maintain a safe service ecosystem. If you find indications of Arqonara infrastructure abuse that violates this policy, please report it immediately in writing with relevant log evidence or IP addresses to: [email protected].
